Landlord legislation update

As ever, landlord and property legislation is never far from the government and media's focus and this month has seen the introduction of The Tenant Fees Act 2019. In light of this, we checked in with a firm of landlord lawyers who provided us with more information regarding The Tenant Fees Act 2019, Section 21 notices and Form No. 6A.

"The Tenant Fees Act 2019 bans letting fees and caps tenants’ deposits to no more than 5 weeks’ rent where the total annual rent is less than £50,000, or 6 weeks’ rent where the total annual rent is £50,000 or above."

"Where a landlord is in receipt of a “prohibited payment or holding deposit” then section 17 of the Tenant Fees Act 2019 prevents them from serving a section 21 notice (although the situation can be rectified if the sums are repaid in the prescribed manner)."

"Form No. 6A is the prescribed form which must be used by landlords (or their representatives) when giving tenants notice under section 21 of the Housing Act 1988."

"Regulation 2 of The Assured Tenancies and Agricultural Occupancies (Forms) (England) (Amendment) Regulations 2019 introduces the new form which came into force on 1 June 2019."

"The new Form No. 6A has been updated to provide for the Tenant Fees Act 2019, which applies to all tenancies signed on or after 1 June 2019."
